Terms of Use
These Terms of Use ("Terms") govern access to and use of the Source MLS, Inc. website, software, tools, services, trademarks, and related technology (collectively, the "Source MLS Services"). By accessing or using the Source MLS Services, or by clicking "I Agree," you agree to these Terms.
If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization.
1. About Source MLS
Source MLS, Inc. is a nonprofit organization created to promote consistent attribution of real estate listing sources and to provide tools that support transparency, branding, and analytics for MLS listing displays.
Source MLS does not own MLS listing data and does not license listing data.
2. Who These Terms Apply To
These Terms apply to:
- Visitors to the Source MLS website
- Users who create accounts or access Source MLS Services
- Developers, vendors, and others who access Source MLS tools, documentation, or APIs
- Any user of Source MLS trademarks or branding
Additional terms may apply depending on your role, including MLS Member Agreements and Display and Usage Requirements.
3. The Source MLS Services
Source MLS may provide:
- A public website (SourceMLS.org)
- Software and tools for attribution and analytics
- Tracking and reporting services
- Logos, trademarks, and branding assets
- Documentation and technical resources
Source MLS may modify, suspend, or discontinue any part of the Services at any time.
4. Accounts and Access
Some features require an account or credentials.
You agree to:
- Provide accurate and current information
- Maintain the security of your credentials
- Use the Services only for lawful and authorized purposes
You are responsible for all activity that occurs under your account.
5. License to Use Source MLS Services
Subject to these Terms, Source MLS grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Source MLS Services solely for their intended purposes.
You may not:
- Reverse engineer or attempt to extract source code
- Circumvent technical protections
- Use the Services in a way that interferes with their operation or tracking
6. Source MLS Trademarks and Branding
Source MLS owns all rights in its names, logos, badges, and trademarks ("Source MLS Trademarks").
You may use Source MLS Trademarks only:
- As expressly permitted by Source MLS
- In accordance with applicable Display and Usage Requirements
- For attribution purposes only
You may not:
- Modify or distort Source MLS Trademarks
- Use them outside listing attribution
- Imply endorsement or affiliation beyond source identification
All goodwill arising from use of Source MLS Trademarks belongs to Source MLS.
7. Display and Tracking Requirements
If you display MLS listings that include Source MLS attribution elements, you must comply with Source MLS's then-current Display and Usage Requirements, including requirements to:
- Display the Source MLS logo as specified
- Trigger Source MLS tracking for each listing detail page view
Failure to comply may result in suspension or termination of access.
8. Data and Analytics
Source MLS may collect and process data relating to:
- Listing display activity
- Usage of Source MLS Services
- Technical performance and compliance
Source MLS may use aggregated or anonymized data to improve its services and to support its nonprofit mission.
9. Acceptable Use
You agree not to:
- Misuse the Source MLS Services
- Interfere with tracking, analytics, or attribution
- Use the Services in violation of law or third-party rights
- Attempt to bypass access controls or security mechanisms
10. Suspension and Termination
Source MLS may suspend or terminate your access to the Services if:
- You violate these Terms
- You misuse Source MLS Trademarks or tracking
- Continued access poses legal, technical, or operational risk
Upon termination, you must stop using the Source MLS Services and Trademarks.
11. Disclaimers
The Source MLS Services are provided "as is" and "as available."
Source MLS makes no warranties regarding:
- Availability or uptime
- Accuracy of listing data (which is provided by MLSs)
- Fitness for any particular purpose
12. Limitation of Liability
To the fullest extent permitted by law, Source MLS will not be liable for indirect, incidental, special, or consequential damages arising out of or related to use of the Services.
13. Indemnification
You agree to indemnify and hold harmless Source MLS from claims arising out of:
- Your misuse of the Services
- Your violation of these Terms
- Your violation of applicable Display and Usage Requirements
14. Changes to These Terms
Source MLS may update these Terms from time to time. Updated Terms will be posted on the Source MLS website.
Continued use of the Services after changes become effective constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles.
